Terms of Service

These Terms of Service ("Terms") govern your access to and use of Coderlust and the products operated under it, including DescribeAI, ListSnap, ReplyAI, PostCraft, PriceWise, and MenuSite (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract under Indian law. If you use the Services on behalf of a business, you represent that you have authority to bind that business.

2. Your account

You are responsible for safeguarding your login credentials and for any activity under your account. Notify us immediately at support@coderlust.com if you suspect unauthorized access.

3. Subscriptions and billing

• Plans are billed monthly or annually in Indian Rupees (₹) via Razorpay using the payment method you provide.
• Subscriptions auto-renew at the end of each cycle unless cancelled. You may cancel at any time from your account dashboard.
• On cancellation, your access continues until the end of the current paid period; no further charges are made.
• We may change prices with at least 30 days' notice. Price changes do not apply to amounts already paid for the current period.
• Taxes (including GST) are charged in addition to plan prices where applicable.

4. Free tier and usage limits

Each product has a free tier with monthly usage limits (e.g., generations, photos, queries). Exceeding the limit on the free tier pauses output until the next month or until you upgrade. Limits are described on the Pricing page.

5. Acceptable use

You agree not to:

• Use the Services for illegal, fraudulent, or infringing purposes.
• Generate or distribute content that is defamatory, obscene, hateful, violates intellectual property rights, or violates Indian law.
• Upload personal data of third parties (your customers, their photos, their queries) without a lawful basis to do so.
• Attempt to reverse-engineer, scrape, or extract underlying AI models.
• Resell or sublicense the Services without our written consent.
• Use the Services to compete with us or to train a competing AI model.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

6. Your content; ownership

You retain all rights to the inputs you submit (product details, photos, catalogs, queries) and the outputs the Services generate for you. You grant us a limited, non-exclusive license to process your inputs solely to provide the Services to you.

7. AI-generated output disclaimer

Output generated by the Services (descriptions, captions, replies, pricing recommendations, menu extractions) is produced by AI and may contain errors, inaccuracies, or culturally inappropriate language. You are responsible for reviewing all output before publishing, sending, or acting on it. We make no warranty that output will be accurate, complete, or fit for any particular purpose.

8. Intellectual property

Coderlust and its branding, design, code, and documentation are owned by us. These Terms do not grant you any right to use our trademarks or copyrighted material except as needed to use the Services.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. We may take the Services offline for maintenance, security, or infrastructure reasons. We are not liable for downtime caused by upstream providers (Google, Anthropic, Razorpay, Vercel, Cloudflare).

10. Limitation of liability

To the maximum extent permitted by Indian law, our aggregate liability for any claim arising out of or relating to the Services is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses arising out of (a) your breach of these Terms, (b) your misuse of the Services, or (c) your violation of any law or third-party right.

12. Termination

You may terminate your account at any time by cancelling from the dashboard or emailing support@coderlust.com. We may terminate or suspend your account for material breach of these Terms. On termination, your data is retained for up to 90 days for recovery, then deleted.

13. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka. Before initiating litigation, the parties agree to attempt resolution in good faith through the grievance channel described in our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email or in-app notification at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
